Official Rules and RegulationsThe Get in Bed National Contest is sponsored by Hilton Hotels and Hudson's Bay Company (collectively, the "Sponsors"). The contest begins at 10:00 AM (local time) on October 15, 2007 and ends at 9:00 PM (local time) on November 4, 2007. All Bay stores are participating in this contest.
TO ENTER: There are two (2) ways to enter the contest: Purchase Entry: Purchase select items from the Soft Home, Mattress, Sleepwear and Intimates Departments at the Bay and present your Hbc Rewards Card to be automatically entered.
No Purchase Entry: To enter, visit
www.thebay.com, complete the online entry form, confirm compliance with the Contest Rules by checking the appropriate box and submit your entry online. In the event of a dispute regarding an online entry, the entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e. the person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail address).
In the event it is determined that an entrant has entered in a fashion not sanctioned by these rules and/or has submitted more than the number of entries permitted by these rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.
All entries must be received on or before 9:00 PM (local time) on November 4, 2007. Only one (1) entry per person will be accepted.
GRAND PRIZE One (1) Grand Prize is available to be won consisting of a weekend trip for two (2) to Toronto, a two (2) night stay at the Hilton Hotel in the Signature Suite, (2) breakfasts and (2) dinners for the winner and guest, a $1000 Hbc gift card and two (2) tickets to see the Toronto production of Dirty Dancing. The Grand Prize includes return economy airfare departing from the Canadian international airport nearest the winner's residence (that serves Toronto). Any additional expenses not included in the Grand Prize including, but not limited to, additional meals, beverages, travel insurance, health insurance, gratuities, in-room movies, taxis, transportation to and from the winner's home and the major international airport nearest his/her Canadian residence, in-destination activities and any departure taxes (payable at the time of booking) are the winner's sole responsibility. The winner and his/her guest must travel on the same itinerary and depart from the same airport. The winner and his/her guest must be available to enjoy the Grand Prize on the dates specified by the Sponsors. Should the winner and/or his/her guest be unable to travel on the dates and at the times designated by the Sponsors, the Grand Prize will be forfeited and awarded to an alternate randomly selected winner. The winner is solely responsible for obtaining all necessary travel documentation.
Approximate retail value of the Grand Prize is $6,000 (CDN) based on a Vancouver, BC departure. Actual value will vary depending on the point of departure. Winner and/or his/her guest are not entitled to the difference, if any, between the stated and the actual value of the Grand Prize. In the event that the winner does not use any portion of the Grand Prize, that portion of the prize will be deemed forfeited and there will be no extension, transfer, substitution or any kind of compensation provided.
DRAWINGA random draw will be held in Toronto at 1:00 p.m. ET on November 12, 2007. The prize will be awarded to the first person whose entry is randomly drawn and who otherwise complies with the Contest Rules. Your chances of winning will depend on the number of eligible entries received during the contest.
ELIGIBILITYTo enter and be eligible to win, the winner must be a resident of Canada who has reached the age of majority in the jurisdiction in which he/she resides and who is not an employee of the Sponsors, their respective affiliated companies or agents (including, in the case of Hudson's Bay Company, Zellers Inc.), their respective advertising or promotional agencies or a member of any such employee's immediate family (regardless of where they live) or a person with whom any such person is domiciled (whether related to the employee or not). In these Official Rules, "immediate family" includes mother, father, brothers, sisters, sons, daughters, partner or spouse. The winner's travel companion must have reached the age of majority in his/her jurisdiction of residence in order to participate in the Grand Prize.
GENERALBy entering the Contest, entrants agree to abide by the Official Rules and the decisions of the Sponsors with respect to all aspects of the contest, which are final. Before being declared a winner, the selected entrant must first correctly answer a mathematical skill-testing question posed by mail or telephone at a mutually convenient time. The selected entrant and his/her guest will be required to sign a declaration and release form (the "Release Form") confirming compliance with the Official Rules, acceptance of the Grand Prize as awarded, without substitution, and releasing the Sponsors, their respective affiliated and related companies, advertising and promotional agencies and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with the Grand Prize or this Contest. The duly completed Release Forms must be returned within the time period specified on the Release Forms or the Grand Prize will be forfeited. The guest's Release Form must be submitted with the selected entrant's Release Form. If the selected entrant declines the prize, incorrectly answers the mathematical skill-testing question, does not return the Release Form within the time specified by the Sponsors or otherwise does not comply with the Contest Rules that entry will be declared void and a subsequent entry will be randomly drawn. One of the Sponsors or a designated agent thereof will contact the Grand Prize winner within thirty (30) days of receipt of the Release Form to begin arranging fulfillment of the Grand Prize. Travel arrangements will be made for the winner and his/her travel guest by the Sponsors or a designated agent thereof and will be confirmed four (4) weeks prior to departure.
The Sponsors accept no responsibility for loss, damage or claims caused by or resulting from the Contest or the Grand Prize associated with this Contest. By entering and accepting the Grand Prize, the winner consent to the use of his/her name, address (city and province) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsors with respect to this Contest.
The Sponsors will not be responsible for late, lost, illegible, incomplete or destroyed entries and all such entries are void. The Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void.
The Sponsors reserve the right, with the consent of the Régie des alcools, des courses et des jeux (the "Régie") in the Province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering or infection by computer virus, the Sponsors reserve the right, with the consent of the Régie, to cancel the Contest and conduct the random draw from all previously received eligible entries.
Quebec residents:Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
All entries become the permanent property of the Sponsors and none will be returned. No correspondence will be entered into except with the selected entrant. This Contest is subject to all applicable federal, provincial and municipal laws.
