HOW TO ENTER AND PLAY: To participate without purchase, see Rule #3.1.b below. A total of approximately 15,666,000 Game Pieces will be available for distribution during the Game Piece Collection Period, or while supplies last, but no later than June 28, 2009. Each Game Piece consists of two parts: an Instant Win Game Piece and an Online Collect & Win Game Piece, or two Online Collect & Win Game Pieces. (Please note that the game piece shown in marketing communication materials – e.g., TV commercials, posters, the Contest website, etc. – might look different than the actual Game Piece.) Contest Sponsor reserves the right to distribute SCRABBLE® at SUBWAY® restaurants “Supercommon Codes” through advertising channels other than as specified herein (including, but not limited to, e-mail, online advertising, and/or free-standing inserts in various print media) in Contest Sponsor’s own discretion. Supercommon Codes are non-unique codes that may be entered to obtain one (1) Letter Tile to enter into play as described in Rule 3.3, below. Supercommon Codes may be used by many people, but only once per person. Game Piece or any portion of a Game Piece or Unique Game Code may not be transferred, duplicated or shared. Game Pieces are null and void and will be rejected if not obtained in accordance with these Official Rules and/or otherwise through legitimate channels; or if any part of the Game Piece is determined by the judging organization to be illegible, reproduced, counterfeited, mutilated, transferred, sold, exchanged, or tampered with in any way; or if any Game Piece and/or contest-related materials contain printing, production, typographical, mechanical or other errors. Game Pieces containing printing or other errors may be replaced with another Game Piece at the sole discretion of the Contest Sponsor, while supplies last.


3.1. How to obtain an Official Game Piece: There are two ways to get an Official Game Piece:


3.1.a. During the Game Piece Collection Period, at any participating SUBWAY® restaurant: Get a Game Piece when you purchase any specially-marked 21-oz fountain drink, or any sandwich (“participating products”), while supplies last. As the Contest progresses, some participating SUBWAY® restaurants may deplete their supply of Game Pieces before others. 3.1.b. Without purchase: For a free Game Piece, while supplies last, send your name, complete address, city, province/territory, and postal code on a self-addressed postage stamped envelope to: “SUBWAY® Free Game Piece Contest”, 2238 Dundas Street West, P.O. Box 59098, Toronto, ON M6R 3B5. Requests must be postmarked by June 29, 2009 and received by July 7, 2009. DO NOT SEND POTENTIAL WINNING GAME PIECES, COMMENTS OR QUESTIONS TO THIS ADDRESS. Limit of one (1) request per postmarked outer envelope (we will not accept more than one self-addressed postage stamped envelope in a single request). You may send as many requests as you wish, however only one (1) Game Piece consisting of one (1) Instant Win Game Piece and one (1) Online Collect & Win Game Piece (or two (2) Online Collect & Win Game Pieces) will be sent in response to each request. No mass or mechanically reproduced requests will be accepted. All requests become the sole property of the Contest Sponsor. Contest Sponsor is not responsible for lost, late, stolen, misdirected, damaged, illegible or postage-due mail or requests. 3.2 How to play the Instant Win Game: Carefully peel the Instant Win Game Piece from the specially-marked participating product to which it is affixed. If the Instant Win portion of your Official Game Piece reads “You’ve Won*!”, then that portion of the Game Piece will contain instructions for the redemption of the prize named: either in-store or online, depending on the prize. In the event you are not an instant winner, an Online Collect and Win Game Piece will be provided to you instead. Food and beverage prizes may be redeemed at a participating SUBWAY® restaurant on a future visit for the prize named, subject to verification and participant’s compliance with these Official Rules. Instant Win prizes other than food or beverage prizes cannot be redeemed in SUBWAY® restaurants, so hold on to your winning Game Piece (do not give it to a SUBWAY® Employee and See Rule #5 for details on how to claim your prize). You must retain the Instant Win Game Piece in order to claim certain non-food/beverage prizes. While the odds of winning an Instant Win prize are 1 in 5.2, there are 3,010,713 Instant Win prizes available to be won and a total of approximately 15,666,000 Game Pieces for distribution throughout the Game Piece Collection Period.

3.3. How to play the Online Collect & Win Game: Carefully peel the Online Collect & Win Game Piece from the specially-marked participating product to which it is affixed. You must retain the Online Collect & Win Game Piece in order to play and to claim certain Online Collect & Win prizes. Each Online Collect & Win Game Piece will feature a specific SCRABBLE® at SUBWAY® restaurants Letter (“Letter Tile”) with a Unique Game Code printed below. Each Unique Game Code can be entered into play only once, and may not be shared or transferred. A Game Piece obtained in Quebec may not be used. During the Online Game Period, visit www.freshenergy.com to play. (You will need Adobe Flash Player 8 or higher to play the Online Collect & Win Game. If you do not have Adobe Flash Player 8 or higher, your browser will automatically be directed to a Web site where you may download the latest version for free. If you need to upgrade but your browser does not automatically direct you to the Web site, visit www.Adobe.com for help.) First-time participants registering for this Contest must read and accept the full Official Rules to access the registration process. All first-time participants will receive an e-mail acknowledging their registration. In the event of a dispute concerning the identity of any online participant, the Authorized Account Holder of the e-mail address used to register will be deemed to be the entrant. The “Authorized Account Holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Any potential winner may be required to show proof of being the Authorized Account Holder. After the registration process is complete, the participant’s SCRABBLE® at SUBWAY® restaurants Game Board (“Game Board”) will appear on the screen. Participants returning to the site to play may log in by entering his/her e-mail address and password to gain access to his/her individual Game Board and any Letter Tiles previously entered into play. The participant must enter the Unique Game Code or Supercommon Code printed on his/her Game Piece. The Unique Game Code or Supercommon Code will cause a corresponding Letter Tile to appear on the participant’s tray. The participant must drag and drop each Letter Tile entered to a matching letter on the Game Board that is active and open for play. Each Letter Tile entered into play will be stored in the participant’s registration file and will appear on participant’s Game Board each time that participant logs in to play. Letter Tiles entered into play may be moved to any active space on the Game Board with a matching letter at any time until the participant completes a Winning Word and submits that word for verification. Each Letter Tile that is part of any Winning Word submitted for verification will no longer be eligible for use in the creation of subsequent Winning Words. All prize level Winning Words may be completed more than once, using different Unique Game Codes. The Online Collect & Win Game Winning Words can be found on the Game Board and in Rule #4 of these Official Rules, along with the odds of collecting Winning Word combinations and prizes associated with each Winning Word combination. If a participant collects all of the Collect & Win Game Pieces required to spell a Winning Word, has placed all of the corresponding Collect & Win Game Letter Tiles into the appropriate spaces on his/her Game Board to spell a Winning Word, has confirmed that he/she wants to submit his/her Winning Word for verification, and has correctly answered the mathematical skill-testing question**, then that participant is the Potential Winner of the prize corresponding to that Winning Word, subject to verification and the participant’s compliance with these Official Rules.


3.4. Gift with tenth Unique Game Code entered: When you enter your tenth Unique Game Code (found on paper sandwich wrappers and 21-oz fountain cups) into play in the Online Collect & Win Game, you will automatically receive a $5 SUBWAY® Card (approximate retail value (“ARV”): $5.00), subject to verification of eligibility and compliance with these Official Rules. This is a one-time gift only (i.e, you will not receive a second gift when entering your twentieth or your thirtieth Unique Game Code into play). Limit of one (1) gift per person/email address. Gift is available while supplies last. This Gift offer is available to the first 14,920 participants who enter his/her tenth Unique Game Code. SUBWAY® Card will be automatically mailed to the participant’s address as provided upon registration. Allow 8 to 10 weeks for verification and shipment after verification. Gift offer not valid on Supercommon Codes.
