The awarded prizes will consist of:
- One (1) American Express-branded prepaid card of $2,500 Reward card for use at select merchants that welcome American Express Cards in Canada; valid for 12 months. No cash value. Winners of the BlackBerry 8330 Packages will each receive a BlackBerry® Curve™ 8330 and one year of Personal Email, IM and Web 30 plan (visit telusmobility.com for complete plan details). Winners will be required to sign the TELUS service terms and will be subject to a credit check. The Personal Email, IM and Web 30 plan will show as a credit on the winner's invoice for a period of one year ($30.00 plus SAF, E911 and applicable taxes per month). Winners are responsible for additional email and web charges over and above that set out in the plan. Winners are also responsible for US data roaming charges and pay-per-use charges. Personal Email, IM and Web 30 rate plan applies to BlackBerry® Internet Service only). At the end of the 12 month term the client has the option to select a different data package or cancel service all together. The client will not be responsible for any swap fee or activation fee associated with their new 8330 BlackBerry® device at the onset of their prize package. If the winner terminates their services before the end of the one year period any credits for the remaining months will be cancelled.
Prize must be accepted as awarded and cannot be exchanged with TELUS for cash. No telephone contact or correspondence will be entered into except with the winning entrants. TELUS reserves the right to substitute any portion of the Prize with a prize of equivalent value and/or to terminate or withdraw this contest at any time. The decisions of the contest judges are final.
TELUS does not accept entries for this contest by phone, fax, courier, mail or e-mail. All entries become property of TELUS, which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries during the promotional period, for any problems or technical malfunction of any servers, access providers, equipment, software, or for any failure of any entry to be received by TELUS on account of technical problems. TELUS reserves the right, at its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of TELUS and its directors, officers, representatives, advertising and promotional agencies, divisions and subsidiaries, corrupt the security or proper administration of the contest. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants agree to abide by the Contest Rules.
To be eligible an entry must take place before the contest closing date of April 15, 2009 11:59 p.m. EST. This promotion is open to all TELUS consumer clients residing in Canada, excluding employees of TELUS and its advertising and promotional agencies, and members of their respective immediate families and any person domiciled with any of the above.
A random draw for the Prizes will take place on or about April 16, 2009 (after 12:00pm EST) at the TELUS office located at 200 Consilium Place, Scarborough, Ontario by a TELUS representative. The selected entrants will be notified by telephone within four business days of the draw. If the selected entrants cannot be reached within four business days, or if a selected entrants do not meet all of the conditions described herein, another entrant will be selected from the remaining eligible entries. To win, the selected entrant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a pre-arranged mutually convenient time.
The winning entrant of the Prize or, if the winning entrant is under the age of majority, his/her parent or a legal guardian, must (a) answer a mathematical skill testing question and (b) must sign a standard form waiver confirming their acceptance and compliance with Contest Rules and releasing TELUS, its affiliated entities and partnership interest holders, and each of their directors, officers, employees, representatives, advertising and promotional agencies from any and all liability arising out of, pursuant to, or as a result of the carrying out of the contest including liability arising from the promotion and acceptance of and usage of the Prize as awarded. Failure to comply with the Contest Rules or to sign and return the release forms within 14 days of receipt will result in disqualification and another entry will be drawn.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
All entrants that are customers of TELUS at the time of entry and/or at the time of prize awarded must have their TELUS accounts in good standing (with a current account balance or one that is no more than 30 days past due) in order to be eligible to win the prize. All Pay and Talk entrants must have a positive balance in their Pay & Talk account at the time of entry, and/or at the time the prize is awarded.
The chances of winning are dependent upon the total number of entries received. This contest is subject to all federal, provincial and municipal laws and regulations.
